Pool & Spa
Carson City Health and Human Services regulate and oversee the construction and operation of all public bathing places including swimming pools, hot springs, and spas to ensure safe water quality and to protect the health of the public and environment. “Public pool” means any structure, basin, chamber, or tank containing an artificial body of water intended to be used collectively by numbers of persons for swimming or bathing operated by any person whether he be owner, lessee, operator, licensee, or concessionaire, regardless of whether a fee is charged for use.
This does not include pools at private residences that are controlled by the homeowner, the use of which is limited to swimming or bathing by family members or their invited guests.
Public bathing places shall have a health permit as required by Carson City Municipal Code before beginning any operation and shall be inspected at least once a season in accordance with CCMC and the Nevada Administrative Code 444.
Any new construction, remodel of existing structures, equipment, or modification to the circulation system (e.g., chemical feeders, circulation pumps, filters, etc.) require plans to be submitted for review by the Environmental Health Department. ANY change in the above equipment requires approval from the health department.
Carson City requires that every “public pool” must be maintained under the supervision of a qualified operator who is responsible for the sanitation and safety of the facility and the maintenance of its equipment and records. According to NAC 444.262 an establishment shall hire a qualified operator or provide the existing operator with sufficient training to reliably maintain the water chemistry within the required limits.
A Certified Pool/Spa Operator (CPO) Certification program shall be considered the minimum training necessary for an operator deemed to be inadequate. Failure to comply may result in permit suspension and facility closure.
There must be at least one Certified Pool Operator onsite at all times.
Any deficiencies identified that pose a threat to public health or the environment require the pool and/or spa to be closed and the permit to be suspended. Once all conditions have been adequately evaluated, and a re-inspection is completed, the permit may be reinstated, and the pool or spa may be re-opened.

The requirements for adequate maintenance and compliance with health laws are presented. For the purpose of this guide, the term “pool” shall apply to all of the above, except where spas, hot tubs and natural baths are specifically mentioned.
